I. Policy Statement

Holy Trinity Orthodox Seminary will track, report and disclose information regarding crimes and crime prevention in accordance with the standards and procedures set forth in this policy.

II. Reason for Policy

Although not required by law on account of the status of Holy Trinity Orthodox Seminary as a private, non-profit educational institution which receives no state or federal aid, including federal student loans, this policy is intended to enable the Seminary to comply with the spirit of, but not the letter of the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act.

III. Applicability of the Policy

All members of the Seminary community should be familiar with this policy.

VI. Definitions

Term

Definition

Campus

(1) any building or property owned or controlled by the Seminary within the same reasonably contiguous geographic area of the Seminary and used by the Seminary in direct support of, or in a manner related to, the Seminary’s educational purposes, including residence halls; and (2) property within the same reasonably contiguous geographic area of the Seminary that is owned by the Seminary but controlled by another person, is used by students, and supports Seminary purposes.

Non-campus Building or Property

(1) any building or property owned or controlled by the Seminary; and (2) any building or property (other than a branch campus) owned or controlled by the Seminary that is used in direct support of, or in relation to, the Seminary’s educational purposes, is used by students, and is not within the same reasonably contiguous geographic area of the Seminary’s main campus.

Public Property

All public property that is within the same reasonably contiguous geographic area of the Seminary’s main or branch campuses, such as a sidewalk, a street, other thoroughfare, or parking facility, and is adjacent to a facility owned or controlled by the Seminary if the facility is used by the Seminary in direct support of, or in a manner related to, the Seminary’s educational purposes.

VII. Procedures

Information for Students, Prospective Students and Employees

The Seminary shall keep a record of its crime reports including results of investigations as available, and copies of its Campus security policies. These shall be available to all current students, prospective students, employees and applicants for employment. The Campus security policies will include the following:

  1. A statement of the Seminary’s current policies regarding procedures and resources for students and others to report criminal activity or other emergencies and the Seminary’s policies concerning the response to such reports.
  2. A statement of the Seminary’s current policies concerning security and access to Seminary facilities, including Seminary residences, and security considerations used in the maintenance of Seminary facilities.
  3. A description of the type and frequency of programs designed to inform students and employees about Campus security procedures and practices and to encourage students and employees to be responsible for their own security and the security of others.
  4. A description of the Seminary’s crime prevention programs.
  5. A statement of the Seminary’s policy concerning the monitoring and recording through local police agencies of criminal activity at any off-campus student organizations which are recognized by the Seminary and that are engaged in by students attending the Seminary, including any student organizations with off-Campus housing facilities.
  6. A statement of the Seminary’s policy regarding the possession, use and sale of alcoholic beverages and enforcement of state underage drinking laws and a statement of the Seminary’s policy regarding the possession, use and sale of illegal drugs and enforcement of federal and state drug laws, and a description of the Seminary’s drug or alcohol abuse education programs as required under 20 U.S.C. § 1011i.
  7. A statement advising the Seminary community where law enforcement agency information concerning registered sex offenders may be obtained.

Crime Statistics Reports

The Seminary will make the report available on the Seminary’s website and provide a copy upon request within 10 working days. Requests for a hard copy should be made to the Seminary administration.

Holy Trinity Orthodox Seminary shall indicate in any campus catalog, student handbook or published view book how to access the campus crime information. The information included in these publications shall also include the United States Department of Education's web site address for campus crime statistics and a campus phone number for a designated Seminary campus contact who is authorized to provide such statistics for the Seminary.

Timely Reporting

The Seminary will make timely reports to the Seminary community about any crimes that are considered to be a threat to students and/or employees, and are reported to Campus Safety and Security. The reports will be provided to students and employees in a manner that is timely and that will aid in the prevention of similar occurrences. This might include postings, emergency alerts, Seminary web pages, and media releases.

Campus Safety & Security Daily Log

  1. Campus Safety and Security will make, keep and maintain a daily log setting forth all crimes that have been reported to the seminary administration. The daily log will be written in an easy-to-understand form and will contain: the nature, date, time and general location of each crime; and the disposition of a criminal complaint, if known.
  2. Unless prohibited by law, entries will be open to public inspection within two business days of the time the initial report is made to the administration.
  3. If new information about a log entry becomes available to the administration, then the new information will be recorded in the log within two days of the information becoming available to the administration.
  4. HTOS administration will not release log information if it has clear and convincing evidence that the release of such information would jeopardize an ongoing criminal investigation or the safety of an individual, cause a suspect to flee or evade detection, or result in the destruction of evidence.

VIII. Forms/Online Processes

The Advisory Committee on Campus Safety and Security will provide upon request all campus crime statistics.

Law enforcement agency information relating to convicted sex offenders is available at: http://criminaljustice.state.ny.us/nsor/.
